陳靜芳律師受邀擔任 TAAS 踏實數位「金融機構數位資產實務轉型」系列講座講者

本所主持律師陳靜芳律師受邀擔任 TAAS 踏實數位「金融機構數位資產實務轉型」年度系列講座專題講者。隨 VASP 專法上路在即，陳律師就台灣金融機構發展合格託管與數位資產交換業務之風險管理課題分享觀察。

演講聚焦加密資產特有之風險，說明冷、熱錢包管理機制，以及保險之承保範圍、保額與除外責任是否足以涵蓋客戶資產，並探討資產分離保管之落地挑戰。陳律師指出，現行內控與法令面對此類新型風險須有針對性之監理，並以境外架構將錢包保險覆蓋率納入牌照取得與維持要件之「間接監理」模式為借鏡。

陳律師並以 Bybit 2025 年約十五億美元失竊事件檢視託管制度缺口，輔以霸菱銀行內控失靈之教訓，剖析保險條款細節如何成為事故發生時保險人拒賠之關鍵，提醒業者規劃數位資產業務時應同步檢視其風險移轉與保險安排之有效性。

Ms. Jingfang Chen, the managing partner of our firm, was invited to serve as a featured speaker for TAAS Digital’s annual lecture series, “Digital Asset Practice Transformation for Financial Institutions.” As Taiwan’s VASP special legislation is expected to take effect soon, Ms. Chen shared her observations on the risk management issues financial institutions may face when developing qualified custody services and digital asset exchange operations.

Her presentation focused on risks specific to crypto-assets, including cold and hot wallet management, insurance coverage, policy limits and exclusions, and the practical challenges of segregated asset custody. Ms. Chen also discussed the need for more targeted supervision under existing internal control and legal frameworks, and referred to offshore models that incorporate wallet insurance coverage into licensing requirements as a form of indirect supervision.

Ms. Chen further examined the custody gaps revealed by the 2025 Bybit theft of approximately USD 1.5 billion, drawing on the lessons from Barings Bank’s internal control failure. She emphasized that insurance policy terms may become critical in claim disputes and reminded market participants to review the effectiveness of their risk transfer and insurance arrangements when developing digital asset businesses.
